CPT 99223: Initial Hospital or Observation Care, High Decision Making

99223 reports a first hospital inpatient or observation visit when the decision making is high or the day's total time reaches the 75 minute level. It is the only initial level that takes Medicare's prolonged service code, G0316, from 90 minutes.

In short: 99223 is the top initial hospital code, selected by high MDM or by time. When time sets the level and the date reaches 90 minutes, G0316 adds a unit for each further 15. The principal physician of record adds AI, and a physician and NPP can split the visit with FS.

What Does CPT 99223 Report?

99223 is the top initial hospital code. It reports the first visit of a hospital inpatient or observation stay when the decision making is high, or when total time on the date reaches the 75 minute level CMS shows in its short label. It is the only initial code Medicare pairs with a prolonged service code.

How Do You Choose Between 99222 and 99223?

Pick the level the note supports by high MDM or by total time, never by the length of the history or exam. Chapter 12, section 30.6.9.1 F, says a medically appropriate history or exam is required but no longer used to select the visit level.

MDM is high when the problems, the data and the risk all reach the high tier of the AMA grid; that grid is AMA material and is not reproduced here. For time, count the practitioner's own qualifying work on the date. Chapter 12 lists activities such as reviewing tests, performing the exam, counseling, ordering, documenting and care coordination, and excludes separately billed services, travel and general teaching (section 30.6.18 B).

Time on the date can span settings. The MLN booklet says time with the same patient on the same day in several settings, or across a move from outpatient to inpatient status, can count toward the base code.

When Can G0316 Be Added to 99223?

When time selects the level and total time reaches 90 minutes on the date. Chapter 12, section 30.6.15.3, and MLN006764 Table 4 give 90 minutes for 99223, which is the 75 minute label plus 15. The October 2026 HCPCS file describes G0316 as each added 15 minutes beyond the total time of the primary service, and lists it with 99223, 99233 and 99236.

CPT's own prolonged code does not apply: in RVU26D, 99418 has status I and G0316 has status A. Prolonged services are not reported with ED visits or critical care, and CMS assigns no frequency limit.

Example (Made Up)

A hospitalist documents 108 total minutes on the admission date and selects the level by time. That is 33 minutes past the 75 minute label, so two full 15-minute units. The claim carries 99223 and G0316 with 2 units.

When Does 99223 Need Modifier AI?

Only the principal physician of record appends modifier AI. Section 30.6.9.1 F says the modifier identifies the physician who oversees the patient's care from other physicians furnishing specialty care, and section 30.6.9.1 G says Medicare treats only one M.D. or D.O. as principal.

Specialists who perform their own initial evaluation can bill 99221 to 99223 without AI. Consultation codes are not recognized for Part B payment (section 30.6.10), which is why an infectious disease or cardiology first inpatient visit is often a 99223 or 99222. See infectious disease billing.

Can 99223 Be a Split or Shared Visit?

Yes, in a facility setting, when a physician and an NPP in the same group each do part of it. Section 30.6.18 says that since 2024 the practitioner who spends more than half of the total time, or who performs the substantive part of the MDM, bills; the claim carries modifier FS. Only distinct time counts, and one practitioner must have in-person contact with the patient.

For a split or shared visit with prolonged time, the substantive portion is based on time alone: more than half of the combined total, including the prolonged minutes.

How Does 99223 Appear on the Claim?

On the CMS-1500, Item 24D carries 99223 with AI or FS as needed, Item 24G carries 1 unit and Item 24B carries POS 21 for an inpatient or 22 or 19 for an outpatient hospital. G0316 is its own line with its units.

The practitioner MUE table effective October 1, 2026 lists 99223 at 1 per date, indicator 3, and G0316 at 4 per date, indicator 3. Related reading: hospitalist billing and CPT 99233.

Which Fields Carry 99223, AI and G0316?

All three go on the professional CMS-1500. 99223 sits in Item 24D with its modifiers: Chapter 26 allows up to four on a line, so AI and FS can both appear. G0316 is a separate service line below it, with its own units in Item 24G.

Still have a question?

Ask a billing lead directly. A 20-minute call, Monday to Friday, 9am to 5pm Eastern.

01How do I choose between 99222 and 99223 for an admission?

Use high MDM or the 75 minute level of total time on the date for 99223, and moderate MDM or the 55 minute level for 99222. History and exam must be appropriate but do not set the level. If time is used, count only the practitioner's own qualifying work.

02How many minutes make G0316 billable with 99223?

Ninety total minutes on the date, when time was used to select the level. Each additional 15 minutes is one unit. The 90 comes from Chapter 12, section 30.6.15.3, and MLN006764 Table 4, and the MUE for G0316 is 4 per date.

03Does every specialist add AI to the initial visit?

No. Only the principal physician of record appends AI, and Medicare considers only one M.D. or D.O. to hold that role. Other specialists who perform their own initial evaluation still bill 99221 to 99223, but they leave AI off the claim line.

04Can an NP and physician share a 99223?

Yes in a facility setting. The practitioner with more than half of the total time, or the substantive part of the MDM, bills, and modifier FS is added. Joint time counts once, and one of the two must see the patient in person.

05Does Medicare accept consultation codes for the first inpatient visit?

No. Section 30.6.10 says consultation codes are not recognized for Part B payment since 2010. A specialist reports the initial hospital code that fits the work, and may report a subsequent hospital code for a first service when the record supports it.
