Business days skip Saturdays, Sundays and U.S. federal holidays (a holiday on a weekend is counted on its observed day). Offers and the decision assume the parties jointly pick the IDR entity on the third business day. Under the newer rule text they count from final selection, after the entity's conflict review, which can be later. Dispute settings such as extenuating circumstances can change a date. This is not legal advice. Deadlines can change, so check the rule.

In short: the calculator turns one date, the initial payment or denial, into the full federal timeline: notice, open negotiation, the 4 business day IDR window, entity selection, offers, decision and payment. It counts business days under 45 CFR 149.510 and shows where a 2026 rule change is not yet in force.

How Do I Use the NSA Deadline Calculator?

Enter the date the plan or issuer paid the claim or sent the notice of denial, then read the table. Two optional fields let you test a real plan: the date you send the open negotiation notice, and the date you start federal IDR. Leave them blank and the tool assumes the last permitted day for each.

1
Enter the Payment or Denial Date
Use the date your office received the initial payment or the notice of denial, from the remittance advice. This starts the 30 business day clock to send the notice.
2
Add Your Notice Date If You Have One
The date you send the open negotiation notice moves every later row. Blank means the tool uses the last permitted day.
3
Add Your IDR Start Date If You Have One
If it falls outside the 4 business day window, the tool shows a warning.
4
Read the Table and Copy the Dates
Each row gives the date and the rule. The warnings flag a notice or an IDR start that is late.

How Is Each Deadline Counted?

Every date below is counted in business days, which skip Saturdays, Sundays and U.S. federal holidays. In the preamble to the June 4, 2026 federal IDR operations final rule, the Departments said that for calculating Federal IDR process timelines, business days do not include Federal holidays and weekends. The calculator uses the 11 legal public holidays in 5 U.S.C. 6103(a), with a Saturday holiday observed on Friday and a Sunday holiday observed on Monday.

The eCFR definitions in 45 CFR 149.30 do not define business day, so that preamble sentence is the official statement. A period that "begins on the day" counts that day as day 1 when it is a business day, and otherwise the next business day.

StepHow longRule
Send the open negotiation notice30 business days beginning on the day you receive the initial payment or denial45 CFR 149.510(b)(1)
Open negotiation period30 business days, beginning on the day the notice is first sent45 CFR 149.510(b)(1)
Other party responds to the noticeNo later than the 15th business day of the period (newer rule text, not yet applicable)45 CFR 149.510(b)(1)(i), as amended June 4, 2026
Start federal IDRA 4 business day window right after open negotiation ends45 CFR 149.510(b)(2)(i)
Agree on the IDR entity3 business days after the date of IDR initiation45 CFR 149.510(c)(1)
Secretary notifies the parties of a selected entityNo later than 6 business days after IDR initiation, if the parties did not agree45 CFR 149.510(c)(1)
Submit offers10 business days after the entity is selected45 CFR 149.510(c)
Entity decision30 business days after the entity is selected45 CFR 149.510(c)
Pay the determined amount30 calendar days after the determination45 CFR 149.510(c)(5)(ix)

The date of IDR initiation is the date the Secretary receives the notice of IDR initiation, not the day you prepare it. File early in the window, because a notice that arrives after the fourth business day makes the dispute ineligible.

What Does a Worked Example Look Like?

Example: Made-Up Dates, Illustrative Only

A payer pays an out-of-network emergency claim on Monday, November 2, 2026. The practice sends its notice on Monday, November 16, and starts IDR on the last day of the window. Veterans Day, Thanksgiving, Christmas Day and New Year's Day fall inside the count and are skipped.

Initial payment receivedMon, Nov 2, 2026
Last day to send the noticeTue, Dec 15, 2026
Notice sentMon, Nov 16, 2026
Other party's response (newer text)Mon, Dec 7, 2026
Open negotiation endsTue, Dec 29, 2026
IDR windowWed, Dec 30, 2026 to Tue, Jan 5, 2027
Entity jointly selectedFri, Jan 8, 2027
Offers dueMon, Jan 25, 2027
Decision dueTue, Feb 23, 2027
Latest payment if decided on the last dayThu, Mar 25, 2027

In this example the notice went out well before its last day, so open negotiation ends earlier than it would have on the last permitted day. Change the notice date and the IDR window moves with it.

Did the 2026 IDR Operations Rule Change These Deadlines?

Not yet for most of them. The final rule, published June 4, 2026 at 91 FR 33900 (document 2026-11140), took effect August 3, 2026, but its changes to open negotiation, initiation, entity selection and the offer and decision timing apply only to disputes with open negotiation periods that begin 90 calendar days after the Departments announce that portal functionality is available. Until each applicability date, the rule says parties must keep following the prior text of 45 CFR 149.510.

CMS's August 7, 2026 implementation timeline says the Departments expect to build those functions in the IDR Gateway in Spring 2027, in the order open negotiation, initiation, entity selection, withdrawals, then extensions. CMS will post a notice, with the applicability date, on its No Surprises Act notices page before each one starts.

ChangeWhen it applies
15th business day response to the open negotiation notice90 calendar days after the Departments announce open negotiation functionality
Offers and decision timed from final selection of the entity, with a 5 business day eligibility review90 calendar days after the Departments announce the matching functionality
Batching changesDisputes with open negotiation periods beginning on or after November 1, 2026
$15 administrative fee per party per disputeDisputes initiated on or after June 11, 2026

When a row changes, this page and the calculator will be updated and the date noted here. The full rule is covered on the 2026 IDR operations rule page.

What Does the Calculator Not Cover?

  • State processes, including Texas TDI mediation and other state pathways, which have their own deadlines. See state surprise billing laws.
  • Extensions for extenuating circumstances, which can change a date.
  • Entity selection by the Secretary: offers and the decision assume the parties jointly pick the entity on the third business day after initiation.
  • The payment on an agreed rate (30 business days before November 1, 2026, and 30 calendar days from that date), the administrative and certified IDR entity fees, and batching eligibility. Batching is explained in batching claims.
  • Whether the claim qualifies for federal IDR at all, or what to offer. The qualifying payment amount is the usual starting point for an offer.

Treat the output as a working calendar and confirm anything close to a deadline against the rule text. It is not legal advice.

How We Handle NSA Deadlines

Deadline management is one part of our out-of-network work under federal IDR and applicable state pathways: eligibility assessment, open negotiation, dispute submissions, documentation validation and outcome tracking. We track each deadline, keep documentation accurate and pay required fees on time. For the full service, see out-of-network billing and IDR, or book a call and send us a claim to count.

For the steps behind the dates, read open negotiation and the federal IDR process. Filing limits for ordinary claims are in the timely filing calculator.

FAQ

Common Questions

Straight answers from the team that does the work.

Still have a question?

Ask a billing lead directly. A 20-minute call, Monday to Friday, 9am to 5pm Eastern.

01Are weekends and holidays counted in NSA deadlines?

No. In the preamble to its June 4, 2026 final rule, the Departments said business days for Federal IDR timelines do not include Federal holidays and weekends. The calculator skips both, using the 11 legal public holidays in 5 U.S.C. 6103(a) with Friday or Monday observance.

02Which date starts the 30 business day clock?

The day your office receives the initial payment or the notice of denial. Under 45 CFR 149.510(b)(1), you have the 30-business-day period beginning on that day to send the open negotiation notice. The negotiation period itself then begins the day the notice is first sent.

03How long do I have to start federal IDR?

Four business days. Under 45 CFR 149.510(b)(2)(i), the notice of IDR initiation goes in during the 4-business-day period right after the open negotiation period ends. The date of IDR initiation is the date the Secretary receives the notice.

04Why does the table show a 15th business day response?

The June 2026 rule added it to 45 CFR 149.510(b)(1)(i): the party that receives the notice responds no later than the 15th business day of the period. It applies 90 calendar days after the Departments announce the open negotiation functionality, so it is not yet required.

05Do offers and the decision run from joint selection or final selection?

The calculator assumes the parties jointly select the entity on the third business day after initiation, then adds 10 and 30 business days. The newer rule text counts from the date of final selection, after the entity's conflict review, which can come later.

06Does the tool work for state-regulated plans?

No. It follows the federal process in 45 CFR 149.510 only. State processes, including Texas TDI mediation, have their own steps and deadlines, and the federal timeline does not apply to claims handled under them. Check the state rules before you count.

07Can a deadline change after I enter a date?

Yes. The rule can change, and extenuating circumstances can extend a date. The 2026 operations rule phases in new open negotiation and initiation timing after CMS announces the portal functionality. Recheck any date near its deadline against the current rule text and the CMS notices page.
