Newark Medical Billing: Arbitration, Trauma, PIP and Charity Care

A Newark hospital or emergency group works under four New Jersey rule sets at once: out-of-network arbitration, the auto no-fault fee schedule, charity care and a Level I trauma system centered on University Hospital. This page covers what each one changes for a claim, using New Jersey Department of Banking and Insurance (DOBI) and Department of Health documents.

In short: newark billing differs from the rest of the state because University Hospital is the only Level I trauma center for northern New Jersey, Essex County sits in the PIP fee schedule's North Region, and every acute care hospital must run the state's charity care program. DOBI's 2025 decision list shows providers winning most emergency arbitrations, but the claim must qualify first.

How Should a Newark Emergency Group Use New Jersey's Published Arbitration Decisions?

DOBI publishes a list of out-of-network arbitration decisions and awards. The 2025 list covers arbitrations decided from January 1 to December 31, 2025, and each row shows the specialty, the CPT codes, whether the case was emergency or inadvertent, both final offers, the decision and the total award.

Because the arbitrator picks one side's final offer, the total award on a row matches either the provider's offer or the carrier's. The New Jersey state page explains the steps and the $1,000 gap rule, so this page does not repeat them. For Newark, the practical use of the list is to find rows for your own specialty and CPT codes before you set a final offer.

The specialty column lets you search for comparable cases. Procedure-heavy specialties such as anesthesia and surgery appear often, so an emergency physician group should build each case from its own charge data and the carrier's allowed amount, and treat the list as context rather than precedent.

The two offers on a row often sit far apart, so the arbitrator is choosing between very different positions and the quality of your documentation matters. Out-of-network billing and IDR is how we prepare those files.

When Does a Newark Claim Use New Jersey Arbitration Instead of Federal IDR?

A Newark claim uses state arbitration when the patient's plan is an insured plan issued in New Jersey, a MEWA (multiple employer welfare arrangement), the State or School Employees' Health Benefits plan, or a self-funded plan that opted in. It uses federal IDR when a self-funded plan has not opted in. DOBI's Bulletin 21-14 grid sets this out.

The grid shows two older processes beside the arbitration, so check which one your dispute belongs to. The Independent Health Care Appeals Program handles medical necessity questions, and the Program for Independent Claims Payment Arbitration covers payment for services that are not inadvertent or emergency. DOBI names MAXIMUS as the arbitration organization for the out-of-network process.

Do not guess at a self-funded plan. Look at the member card and DOBI's opt-in list, as the state page describes, and keep a copy of what you saw on the date you filed. See our state surprise billing laws guide for how the two systems compare.

Which Newark Hospital Is the Level I Trauma Center, and Who Sends Patients There?

University Hospital is northern New Jersey's Level I trauma center. Its trauma page says the state designated the Eric Muñoz Trauma Center as Level I for northern New Jersey in 1987, and describes it as the sole Level I center for that region. The hospital's home page describes a 519-bed academic medical center, and calls it the state's public academic health center.

The Department of Health keeps a list of trauma transfer agreements, and several name University Hospital as the receiving Level I center. Those entries include Saint Michaels, East Orange General Hospital, Christ Hospital, St Mary's Hospital, St Joseph's Hospital and Jersey City Medical Center, a Level II hospital. The list names the agreements but not their volume, so it shows who can send patients, not how many.

Billing follows the transfer. A patient treated at East Orange General and moved to University Hospital creates a professional and a facility bill at each site, and each bill needs its own dates and diagnoses. The trauma designation also decides which fee schedule applies if an auto policy pays, as the next section shows.

Newark Beth Israel Medical Center appears on the same list only as a hospital sending patients to RWJBarnabas Health facilities. Check its trauma status and payer contracts directly with the hospital.

How Does New Jersey PIP Change a Newark Hospital's Auto Accident Claims?

When a New Jersey auto policy's PIP (personal injury protection) coverage pays, the insurer's limit is the lower of the fee schedule amount or the usual, customary and reasonable fee, under N.J.A.C. 11:3-29.1(a). Essex County, where Newark sits, falls in the schedule's North Region. This applies only to PIP, not to a patient's health insurance.

N.J.A.C. 11:3-29 rules a Newark ED and trauma office should know
SituationWhat the rule saysSection

For University Hospital, that means a trauma-activation account billed with the -TS modifier sits outside the schedule, while a non-trauma ED visit at another Newark hospital falls under the ER modifier rules. A missing modifier can send an account into the wrong fee path, so check it before the claim leaves.

The subchapter is posted by DOBI. A rule can change, so confirm the current N.J.A.C. 11:3-29 text and the PIP fee schedule exhibits on DOBI's site before you load fees into your system.

How Does New Jersey Charity Care Affect Newark Self-Pay Accounts?

New Jersey's Hospital Care Payment Assistance program, called Charity Care, applies at all acute care hospitals in the state, and the Department of Health says the hospital decides eligibility when the completed application arrives. The hospital makes the decision within 10 business days of a complete application, and the patient has up to one year from the date of service to apply.

Before charity care, the hospital must screen the patient for insurance and Medicaid. The Department of Health says patients should apply only after being found ineligible for those programs. If the patient does not finish that screening promptly, the hospital may bill and pursue collection regardless of potential charity care eligibility.

The Department of Health also says private physician fees, anesthesiology fees, radiology interpretation and outpatient prescriptions are separate from hospital charges and may not qualify. A Newark physician group billing separately from the hospital should not assume the patient's charity care approval covers its bill. Our patient billing service sets up that conversation.

Which Payers Does a Newark Billing Office Work Most?

A Newark office works Novitas Solutions for Medicare, the five NJ FamilyCare plans, the State Health Benefits Plan and commercial carriers such as Aetna. The state page lists the plans and the filing clocks, and our Medicare and Medicaid guides explain the program workflow. DOBI's Bulletin 21-14 grid lists that plan among those whose out-of-network disputes go to state arbitration.

This page cites no Newark-specific payer contract dispute from an official source, so we name none. Check each carrier's current participation status for University Hospital and the RWJBarnabas Health facilities before you quote a patient balance.

01How does New Jersey out-of-network arbitration through DOBI work for a Newark hospital?

DOBI contracts MAXIMUS as the arbitration organization under the Out-of-network Consumer Protection, Transparency, Cost Containment and Accountability Act. The arbitrator picks either the provider's or the carrier's final offer. A hospital needs an eligible plan and service first. The state page covers the steps and deadlines, so check it before filing.

02When do Newark providers use NJ arbitration instead of federal IDR?

Use state arbitration for insured plans issued in New Jersey, MEWAs, the State or School Employees' Health Benefits plan and self-funded plans that opted in, per DOBI's Bulletin 21-14. Use federal IDR when a self-funded plan has not opted in. Confirm the plan type from the member card and DOBI's opt-in list.

03Which Newark claims fall under the NJ Out-of-Network Consumer Protection Act versus self-funded plans?

Claims for covered persons in insured New Jersey plans and in opted-in self-funded plans fall under the Act. Claims under self-funded plans that did not opt in go to federal IDR instead. The Act covers inadvertent, emergency and urgent services from out-of-network providers, so a routine out-of-network claim does not qualify.

04How do NJ arbitration awards compare with the federal QPA approach?

New Jersey's arbitrator chooses one final offer, and the award on each decision DOBI lists matches one of the two offers. Federal IDR has its own factors, including the QPA, and our IDR process guide lists them.

05Who is the Medicare MAC for New Jersey?

Novitas Solutions is the Medicare Part A and Part B contractor for New Jersey, in Jurisdiction L, per the CMS list of contractors dated March 2023. Medicare requires claims within one calendar year of the date of service under 42 CFR 424.44. The state page has the details and the home health contractor.

06How do no-fault auto (PIP) claims affect hospital billing in Newark?

PIP pays up to the fee schedule or the usual, customary and reasonable fee, whichever is less, and Essex County is in the North Region. Trauma services at Level I and II hospitals are outside the physician and facility fees and use modifier -TS. Emergency room services use modifier -ER.

07Is University Hospital in Newark a Level I trauma center?

Yes. University Hospital says the state designated its Eric Muñoz Trauma Center as the Level I center for northern New Jersey in 1987, and calls it the sole Level I center for that region. Several hospitals have Department of Health transfer agreements naming it as the receiving Level I center.

08How long does a Newark patient have to apply for charity care?

The New Jersey Department of Health says patients have up to one year from the date of service to apply for Charity Care, and the hospital decides within 10 business days of a complete application. The patient must first be screened for insurance and Medicaid, and physician fees are usually billed separately.

09Does charity care cover the physician group's bill at a Newark hospital?

Not necessarily. The Department of Health says private physician fees, anesthesiology fees and radiology interpretation are separate from hospital charges and may not be eligible for reduction. A group should check its own eligibility rules and ask the patient whether a hospital approval exists before writing off or billing the balance.
