IDR operations rule takes effect August 3: what applies and what waits
The federal IDR operations final rule became effective on August 3, 2026, 60 days after its June 4 publication. Only some provisions started to apply on that date. Batching waits for November 1, 2026, remittance codes for 2027, and the notice and selection steps for portal announcements that CMS has not yet made.

In short: August 3, 2026 was the rule's effective date, not the start date for every requirement. A short list applied that day, the $15 fee had applied since June 11, and the rest follows its own date or a Departments announcement.
What became effective on August 3, 2026?
The final rule states that it is "effective on August 3, 2026." The August 28 correction repeats the date in its summary: "The effective date of the IDR final rule was August 3, 2026." The rule is Federal Register document 2026-11140 at 91 FR 33900.
Under CMS's August 7, 2026 timeline guide, four groups of provisions are not tied to portal functionality and carry an August 3 applicability date:
- The definition of a bundled payment arrangement.
- The disclosure requirements about the QPA that payers include with an initial payment or denial.
- The procedures a certified IDR entity uses to retain its entity fee.
- Entity fee payment timing, failure to pay the entity or administrative fee, and how the entity fee is allocated after a determination, agreement or withdrawal.
Which dates apply to which requirement?
The dates arrive in this order.
| Date | What applies | Basis |
|---|---|---|
| June 11, 2026 | $15 administrative fee per party per dispute, for disputes initiated on or after this date | 5 business days after publication |
| August 3, 2026 | The four groups above | Effective date |
| November 1, 2026 | All batching provisions, including the 50 line item limit and the 30 business day cooling off after a batched determination | Disputes with open negotiation beginning on or after this date; CMS notice of August 3, 2026 |
| January 1, 2027 | Specified CARC and RARC use on remittance advice | Items and services furnished on or after this date; CMS guidance of July 17, 2026 |
| 90 calendar days after an announcement | Open negotiation and initiation notices, entity selection, eligibility review, offer and decision deadlines, portal withdrawals | Section 149.510(h); needs a Departments announcement first |
| 90 business days after an announcement | Payer registration in the federal IDR registry | Section 149.530(b)(1) |
Until a provision's date, section 149.510(h)(10) says parties must keep complying with the corresponding requirements in effect before June 4, 2026.
What still waits for portal functionality?
Notice, selection, eligibility review and offer deadline provisions wait for an announcement that the supporting function is live. CMS's guide says the Departments "will provide notice to the public and to disputing parties before the functionality supporting such provisions is available," and that the notice will include the applicability date.
CMS expects the new IDR Gateway functions in Spring 2027, in this order:
- IDR Registry
- Suspension of resubmission of incorrectly batched or bundled disputes
- Open negotiation
- Initiation
- Certified IDR entity selection
- Withdrawal requests submitted through the IDR Gateway
- Extensions
The CMS notices page lists no announcement of an applicability date for these functions as of October 26, 2026. Its newest notice, dated October 14, 2026, says Gateway accounts can submit initiation, response, selection and offer web forms from November 13, 2026, but sets no applicability date for the rule's new notice requirements.
What should billing teams do now?
- Record the open negotiation start date on every new dispute, because November 1, 2026 splits the batching rules.
- Use the notice and deadline rules in force before June 4, 2026 until the Departments announce an applicability date.
- Check the CMS notices page each week for an announcement, since 90 calendar days start counting from the notice.
What is still open?
The portal-dependent dates are unannounced. CMS's August 13, 2026 statement says the Departments are reviewing the Fifth Circuit's en banc opinion in No. 23-40605 on the QPA and anticipate guidance shortly. For the full provision list see the IDR operations rule page, and for the publication itself see the publication post.

01What date did the federal IDR operations rule take effect?
The rule took effect on August 3, 2026, 60 days after its June 4, 2026 publication at 91 FR 33900. Effective is not the same as applicable: CMS's August 7, 2026 guide gives each provision its own applicability date, and many depend on a Departments announcement.
02Which IDR rule changes apply today?
Per CMS's guide, the $15 administrative fee applies to disputes initiated on or after June 11, 2026, and the bundled payment definition, QPA disclosure rules and entity fee procedures applied from August 3, 2026. Batching applies to disputes whose open negotiation begins on or after November 1, 2026.
03Do I file open negotiation notices through the IDR portal under the new rule yet?
Not under the new rule text. The standard form notices apply 90 calendar days after the Departments announce that the supporting functionality is available. As of October 26, 2026 the CMS notices page shows no such applicability announcement, so the earlier rules continue.
